The discovery of the above newspaper article started a trail which resulted in finding information about who was John Forbes and what happened to him. The trail led from an Aberdeen court, to a Prison hulk in England and finally transportation to Australia

Firstly who was John Forbes?
(Family history is noted at end of paragraph)

He was the son of John Forbes from Strathdon who died in Glenbucket and his mother was Jean Cragie who came from Old Meldrum. The family tree goes back to Strathdon in 1644. John junior was born on 23rd April 1797. He married Frances Black form Fordyce on 16th May 1826 in Glenbucket. He was recorded as being a Schoolmaster at that time. Two of their children are recorded as being baptised in Glenbucket, James Duff Forbes on 7th Nov 1828 and Scott on 4th May 1829

The offence:
In 1840 John was taken up before the High court in Aberdeen in front of Lord Montcrieff. He was convicted of uttering forged documents for £18 and 15 shillings and having previously fled from justice. He was convicted and sentenced to 14 years ‘transportation beyond the seas’.

The Punishment
He was taken from the prison in Aberdeen to a Prison Hulk, ‘The Justia’, off Woolwich and held there until transportation on 7th Oct 1840. The prison hulk record is pictured above

He left from Sheerness in the ship ‘Hindostan’, carrying 200convicts and 209 boys. The voyage took 104 days. 210 convict males embarked and one lost his life on the journey. The journey may have seemed harsh but it was less hazardous that of the voluntary immigrants noted on another page , 100 of whom died on one voyage from disease. George Lamb was the ship’s Master and Andrew Henderson, its Surgeon. 30 guards of the 96th Regiment acted as escorts. The ship arrived at its destination at Hobart Tasmania (known then as Van Diemen’s Land) on 19th January 1841 after a voyage of 104 days.

Period of probation: one year and a half
Station of Gang South Port
(Probationary periods: 7-10 year sentence: 2 years' probation; 14-20 year sentence - 3 years; life sentence - 4 years. With good behaviour at the completion of the probationary period, a convict received a probation pass, then a ticket-of-leave, later graduating finally to a conditional or absolute pardon.)

(Class 1: Ticket of leave men working for wages. Their degree of freedom was gained through good conduct thus achieving a higher wage. About 10% of convicts were in this group.)

Conditional Pardon (CP) Approved 14th Nov 1848
(Conditional Pardons (CP). Freed convicts and were granted on the condition that convicts did not return to England or Ireland. The 'condition' was that the ex-convict must to remain in Australia― but not necessarily the original colony of transportation ― for the remainder of their sentence. Original copies of the pardons were sent to England and duplicates remained in Australia. Copies were also given to convicts as a proof of pardon.
An absolute pardon cancelled the unserved part of the sentence, without any conditions. These could not be revoked.)


John would have completed his sentence by 1854 but in Oct 1853 (possibly while still under his conditional discharge) he sailed on the ship Ladybird from Laurenceton Tasmania to Geelong the port for Melbourne. The passenger list is pictured above.
(The Lady Bird was built as schooner rigged steamer with passenger accommodation for 100.Transferred to run a coastal service in 1864in New Zealand by New Zealand Steam Navigation Co 1871 converted to a schooner, gross tonnage 303. 1876-1881 in Union Company fleet. 1905 vessel broken up at Wellington. Hull sunk and used for target practice by HMS Challenger 1906.)

From here the trail becomes confused. If any family members read this, please get in touch and complete the story for us. It seems however that John Forbes stayed in Australia probably in Melbourne. The following clues lead to this assumption.

His wife who is recorded as dying in Scotland but yet it is also recorded that she was buried in Melbourne Australia.

Her daughter, Frances Elizabeth Margaret Forbes, married Robert James Black in Glasgow and in 1872 her death is recorded in Melbourne. Her husband Robert is recorded as arriving in Melbourne on 30 April 1868 on ‘Royal Oak’. He died on 9 Feb 1880 in Fitzroy Victoria Australia
